1 About these terms
This website is provided by Bella Digital Co (ABN 81 754 720 756), a founder-led digital services business based in Perth, Western Australia. “We”, “us” and “our” refer to the business operating under that name. These terms describe the conditions for using this website and its materials.
Please read these terms before using the website. If you do not agree with them, please stop using the website.
These terms concern website use. They do not set the commercial terms for buying website design, optimisation, AI implementation, branding, or consulting services.
2 Enquiries, quotes and client work
Sending an enquiry does not reserve availability, confirm a price or authorise work to begin.
Before starting a project, we will confirm the scope, fees and applicable project terms with you in writing. Ongoing maintenance and support are included only where agreed.
These website terms do not replace the terms agreed for an individual project or limit any rights that cannot lawfully be excluded.
3 Permitted use and website materials
You may view the website and download or print reasonable extracts for personal reference or internal business evaluation of our services, provided you retain any copyright notices and do not misrepresent the source.
Unless otherwise stated, rights in the website's original text, design and other materials belong to Bella Digital Co's legal operator or the relevant rights holder. Third-party assets remain subject to their owners' rights and any applicable licences. No ownership is transferred simply by accessing the website.
Except as permitted by law, a relevant licence or our written permission, you must not republish, sell or commercially reproduce protected website materials. You may link to the website in a way that does not falsely suggest endorsement or a relationship with Bella Digital Co.
Client work, concept examples and other portfolio materials remain subject to the rights and permissions applicable to each item. Their display does not give visitors permission to reuse client branding or assets.
4 Responsible use
You must not use the website unlawfully, impersonate another person, submit misleading enquiries, upload malicious files, interfere with website operations, or attempt to access systems or data without authority. You must not use enquiry facilities to send spam or content that infringes another person's rights.
If you suspect a technical or security issue, contact belladigitalco@gmail.com with enough detail to explain it. Do not access or disclose other people's information while investigating it.
5 Information you submit
Please provide information that is accurate to the best of your knowledge and that you are authorised to share. Do not include passwords, sensitive records or another person's confidential material in a general enquiry. Contact us first if a secure transfer or access arrangement is needed.
You retain any rights you have in material you submit. You permit us to handle it to assess and respond to your enquiry and as otherwise agreed or lawfully required, subject to applicable privacy and confidentiality duties. Sending an enquiry does not grant permission to publish your material, add you to marketing lists or use it to train AI models.
Our Privacy Policy, available through the website footer at https://www.belladigital.co, explains personal information handling, including the providers we use. Reading or using the website is not blanket consent to all data practices.
6 Website information and availability
Website material provides general information about our services and digital topics. It may become outdated, and examples may not suit every business. Obtain advice appropriate to your circumstances before relying on general material for a significant decision.
We do not promise a particular search ranking, number of enquiries, sales result or commercial return from website use or from a general example. Project-specific commitments must be agreed separately. This does not qualify a specific representation we have made or remove an applicable legal obligation.
The website may be temporarily unavailable because of maintenance, faults or provider interruptions. We do not guarantee uninterrupted access or that all content or systems will always be free from error or security issues. Any limitation is subject to section 8.
7 Third party links and tools
We do not control independent providers' content, prices or ongoing availability. We remain responsible for our own conduct and any responsibilities imposed by law.
8 Australian Consumer Law and responsibility
Nothing in these terms or the Disclaimer and Ethical Practices statement excludes, restricts or modifies a consumer guarantee, remedy or other right that cannot lawfully be excluded, restricted or modified. This includes rights under the Australian Consumer Law and liability that cannot lawfully be excluded.
Where applicable, service consumer guarantees include due care and skill, fitness for a disclosed purpose and supply within a reasonable time where no time is agreed. These protections can apply to business purchases as well as personal purchases.
Responsibility for a loss will be determined under applicable law and any enforceable agreement relevant to the circumstances. These website terms do not impose a general indemnity on visitors or a monetary liability cap. They do not require visitors to waive remedies for Bella's own conduct.
9 Website access and changes
We may take reasonable steps to protect the website, including restricting access where necessary to address misuse, a security issue or a legal requirement. Any restriction should be proportionate to the issue. This clause does not permit cancellation of contracted client services outside the client services agreement or applicable law.
We may update website content and these terms. Updated terms will show their version date and material changes will be brought to visitors' attention in an appropriate way. Changes apply prospectively and do not retrospectively remove rights or vary existing client agreements. Where further acceptance is legally required, we will seek it.
10 Concerns and applicable law
Please contact Bella Digital Co at belladigitalco@gmail.com with website concerns or complaints. Include the relevant page, what happened and the outcome you seek. We will consider the concern and respond as soon as possible. Contacting us first is encouraged, but is not a condition that prevents you from seeking urgent relief, contacting a regulator or exercising a legal right.
Subject to mandatory laws and rights that apply elsewhere, these terms are governed by the laws of Western Australia and the applicable laws of Australia. The courts of Western Australia have non-exclusive jurisdiction. This does not require a consumer to give up a right to bring a claim in another competent court or tribunal.
If a provision is unenforceable, it is to be severed to the extent legally possible. The remaining provisions continue only insofar as the law permits. This clause does not make an otherwise unfair term fair.
